DALE L. JOHNSON, Appellant v. NATIONAL OILWELL VARCO, LP, Appellee
On Appeal from the 152nd District Court Harris County, Texas
Trial Court Cause No. 2013-62983
ORDER
The reporter's record was filed on March 8, 2017. On March 17, 2017, appellant filed a motion alleging the reporter's record did not contain all the items he had designated. Appellant moved for an extension to file his brief until the record was complete and asked this court to assess sanctions against the court reporter, Cynthia Martinez Montalvo, and/or hold her in contempt.
On March 23, 2017, appellee filed a motion to supplement the reporter's record with 13 specified items.
On March 28, 2017, Montalvo filed nine volumes of a supplemental reporter's record. Those nine volumes appear to include all but one of the items specified in appellant's motion and four of the 13 items specified in appellee's motion.
We rule on the two motions as follows:
Appellant's motion is granted in part and denied in part. We grant the request for an extension to file his brief. His brief is due May 30, 2017. We deny the request to assess sanctions against Montalvo or hold her in contempt.
We take no action on appellee's motion to supplement the record. The proper procedure for a party to supplement the reporter's record is by written request to the court reporter—no motion or order is needed. Tex. R. App. P. 34.6(d).
