Opinion
November 20, 1961
In an action to recover damages for personal injuries resulting from the alleged improper care and treatment given to plaintiff while she was a patient in defendant's hospital, the defendant appeals: (1) from an order of the Supreme Court, Kings County, dated June 12, 1961, granting plaintiff's motion to direct it to furnish plaintiff's attorney with a true copy of the report of the physical examination of plaintiff conducted by its physician; and (2) from an order of said court, dated August 9, 1961, denying its motion to direct plaintiff to perform an alleged agreement by her trial counsel to supply it with a copy of the reports of physical examinations conducted by her physician concerning the claimed injuries in the action. Orders affirmed, with one bill of $10 costs and disbursements. No opinion. Defendant's time to furnish a copy of its physician's report, as directed by the first order, is extended until 10 days after entry of the order hereon.
