Johnson v. Maricle

Supreme Court of Louisiana
Oct 31, 1980
390 So. 2d 201 (La. 1980)

Opinion

No. 80-C-2189.

October 31, 1980.

In re Ernest Johnson applying for Certiorari, or writ of review, to the Court of Appeal, Third Circuit. Parish of Vernon. No. 7449, 386 So.2d 677.

Granted in part, with order. Otherwise, denied.

ORDER

The trial court rendered judgment in favor of plaintiff and against Henry Maricle, among others. The court also granted judgment on a third party demand against Maricle. Although Maricle did not appeal or seek to have the judgment annulled, the court of appeal declared the judgment invalid as to him.

A judgment cannot be modified on appeal in favor of a party who did not seek relief. Accordingly, the writ is granted as to relator's request to have the judgment against Maricle reinstated, and it is ordered that the judgment of the trial court as to Henry Maricle be reinstated. In all other respects, the writ is denied.

DENNIS, J., would grant the writ.
