ORDER


After making an independent review of the pleadings, files and records in this case, and the findings, conclusions and recommendation of the United States Magistrate Judge filed on May 7, 2001, the court concludes that the findings and conclusions of the United States Magistrate Judge are correct. Petitioner's objections, filed May 14, 2001, are overruled. The findings, conclusions and recommendation of the United States Magistrate Judge are hereby accepted by the court. This action is therefore dismissed with prejudice as barred by the statute of limitations provided in 28 U.S.C. § 2244(d).

It is so ordered.
