ORDER


Before the Court are Plaintiff's and Defendants' counter-motions for summary judgment, and the parties' responses and replies thereto. The Court having made an independent review of the pleadings, files, and records in this case, and having reviewed the findings, conclusions, and recommendations of the United States Magistrate Judge, Plaintiff's objections thereto, and Defendants' objections thereto (which also include Defendants' response to Plaintiff's motion for summary judgment), the Court hereby ADOPTS those findings and conclusions, DENIES Defendants' motion to strike Plaintiff's summary judgment motion, and DENIES Defendants' motion to file another response to Plaintiff's summary judgment motion.

It is THEREFORE ORDERED that Plaintiff's motion for summary judgment is DENIED and that Defendants' motion for summary judgment is GRANTED as to Plaintiff's unlawful arrest claims but DENIED as to Plaintiff's excessive force claim.

It is SO ORDERED.
