Plaintiff Garrison S. Johnson ("Plaintiff") is a state prisoner proceeding pro se and in forma pauperis in this civil rights action pursuant to 42 U.S.C. § 1983. This action was filed on September 4, 2009. On January 11, 2011, the complaint was dismissed, with leave to amend, for failure to state a claim. On January 28, 2011, Plaintiff filed a notice of voluntary dismissal.

"[U]nder Rule 41(a)(1)(I), `a plaintiff has an absolute right to voluntarily dismiss his action prior to service by the defendant of an answer or a motion for summary judgment.'"Commercial Space Mgmt.
