JUDGMENT


This action came on for consideration by the Court, and the issues having been duly considered and a decision duly rendered,

It is ORDERED, ADJUDGED AND DECREED that Plaintiff's claim against the Dallas Police Department be, and it is hereby dismissed with prejudice as frivolous.

It is further ORDERED ADJUDGED AND DECREED that Plaintiff's claim against the arresting police officers, Nekhell P. Galtonde, Stanley Richard Verbal, Misty Bancuren, and White, be and it is hereby dismissed with prejudice as frivolous to it being reasserted when the conditions set out in Heck v. Humphrey are met.

IT IS FURTHER ORDERED that the Clerk shall transmit a true copy of this judgment and the order accepting the Findings, Conclusions and Recommendation of the United States Magistrate Judge to Plaintiff.
