EUGENE JOHNSON & KRYSTAL JOHNSON, Petitioners v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER TO SHOW CAUSE

Courtney D. Jones Judge

On February 13, 2023, counsel for respondent filed a Motion to Dismiss for Lack of Prosecution. This case was called from the calendar of the Court's Richmond, Virginia trial session, conducted in Charlottesville, Virginia, on March 6, 2023. There was no appearance by or on behalf of the petitioners. Counsel for respondent appeared and was heard. Upon due consideration and for cause more fully appearing in the transcript of the proceeding, it is

ORDERED that jurisdiction is retained by the undersigned. It is further ORDERED that respondent's motion to dismiss is taken under advisement. It is further

ORDERED that, on or before April 5, 2023, petitioners shall show cause in writing why respondent's Motion to Dismiss for Lack of Prosecution should not be granted and a decision entered in this case. Failure to respond to this order will likely result in the granting of respondent's motion and entry of decision against petitioners.
