14 A.D.2d 549 (N.Y. App. Div. 1961)

Opinion

In a negligence action to recover damages for personal injuries, the defendant Bunnell appeals, as limited by his brief, from so much of an order of the Supreme Court, Westchester County, dated February 20, 1961, and entered in Dutchess County on February 23, 1961, as denied his motion to dismiss the complaint for failure to prosecute the action. Order, insofar as appealed from, affirmed, without costs. No opinion. Nolan, P.J., Beldock, Ughetta, Christ and Brennan, JJ., concur.
