ORDER ADOPTING REPORT AND RECOMMENDATION


The Court previously referred Plaintiff's appeal from a decision of the Commissioner of Social Security denying her application for disability insurance benefits under Title II of the Social Security Act, 42 U.S.C. §§ 401 et. seq., and supplemental security income under Title XVI of the Social Security Act, 42 U.S.C. §§ 1381 et. seq., Magistrate Judge Vescovo submitted her Report and Recommendation on September 29, 2004, recommending that the decision of the Commissioner be remanded.

No objections to Magistrate Judge Vescovo's report and recommendation were filed.

Upon de novo review of Magistrate Judge Vescovo's report, the Court agrees that the totality of the record demonstrates that Ms. Johnson's application should be remanded to the Commissioner for further consideration of step three in the disability evaluation and for reconsideration of Dr. Siegel's report. The Court therefore ADOPTS the Report and Recommendation in its entirety, remanding the decision of the Commissioner.

SO ORDERED.
