Kevin John, Sr. & Whitney S. Witasick, Petitioners v. Commissioner of Internal Revenue, Respondent

ORDER

Courtney D. Jones, Judge

By Order dated March 11, 2021, this case was assigned to the undersigned. At the parties' request, we set this case for trial at the remote trial session of the Court scheduled to commence at Baltimore, Maryland, on November 1, 2021. On October 15, 2021, petitioners filed a Motion for Continuance (docket entry no. 98) and an accompanying declaration from Mrs. Witasick (docket entry no. 99).

This case has been continued seven times (docket entry nos. 7, 12, 18, 22, 27, 35, 66) since the petition was filed. As such, the Court notes that petitioners are requesting what will be the eighth continuance in this case. Though multiple continuances are generally disfavored, the Court will grant petitioners' motion as the Court is persuaded that a surgeon has scheduled Mrs. Witasick for a medically-necessary surgery on November 1, 2021 recovery from which is likely to extend beyond the November 1, trial session.

Upon due consideration, it is

ORDERED that petitioners' Motion for Continuance, filed October 15, 2021, is granted and this case is stricken from the above-referenced trial session and continued.
