MEMORANDUM AND ORDER PURSUANT TO RULE 1:28

On March 13, 2015, a panel of this court affirmed the Superior Court judgment in this matter. Subsequently, the plaintiff filed with the Supreme Judicial Court a motion to stay for further appellate review, and then filed with that court a motion to remand the case to the board. The Supreme Judicial Court granted the plaintiff ten days to refile the motion to remand with the Appeals Court, and the plaintiff timely did so. In light of Doe, Sex Offender Registry Bd. No. 380316 v. Sex Offender Registry Bd., 473 Mass. 297, 314-316 (2015), and this court's recent decision in Doe, Sex Offender Registry Bd. No. 203108 v. Sex Offender Registry Bd., 89 Mass. App. Ct. 901 (2016), we now vacate the Superior Court judgment affirming the board's designation of the plaintiff as a level three sex offender. We remand the matter to the Superior Court for entry of an order requiring the board to conduct a new evidentiary hearing and to cease disseminating the plaintiff's registry information on the Internet during the pendency of the proceedings.

The board has informed the court that it does not oppose such relief.
