JUSTICE BERKENKOTTER would grant as to the following issue:
Whether the court of appeals misconstrued section 16-8.5-112(4), stating "the county jail may require the defendant to continue to receive the same court-ordered treatment," to mean the county jail is required to forcibly medicate the defendant and lacks discretion to refuse based on resource constraints.
