171 So. 3d 715 (Fla. Dist. Ct. App. 2015)

Opinion

No. 2D14–5306.

01-15-2015

JIANPING LIU, Appellant/Petitioner(s), v. FLORIDA DEPARTMENT OF HEALTH, Appellee/Respondent(s).

Opinion

BY ORDER OF THE COURT.

The petition for review of order of emergency restriction of license is granted. The order of emergency restriction of license is quashed. The order fails to meet the exacting standards of section 120.60(6), Florida Statutes, because it does not contain particularized facts demonstrating an immediate danger to the public health, safety, or welfare. See Bio–Med Plus, Inc. v. State, Dep't of Health, 915 So.2d 669 (Fla. 1st DCA 2005).
