And plaintiffs-appellants, pro se, having moved, inter alia, for leave to amend the summons and verified complaint to clarify that plaintiff Gia Wang LLC assigned its claims in this action to Jia Wang, such that the action may proceed in compliance with CPLRE 321(a), and staying Supreme Court from determining defendant-respondents' pending motion to dismiss (Motion No. 2023-00581), And defendants-respondents having cross moved to dismiss the aforesaid appeal (Motion No. 2023-00883), Now, upon reading and filing the papers with respect to the motion and cross-motion, and due deliberation having been had thereon,
It is ordered that plaintiffs-appellants' motion is denied (Motion No. 2023-00581). It is further ordered that the cross-motion is denied (Motion No. 2023-00883).
