An appeal having been taken herein from an order of the Family Court, Monroe County, entered in the Office of the Clerk of said Court on October 5, 2018, and petitioner-respondent having moved to dismiss the appeal as untimely taken,

Now, upon reading and filing the affirmation of Carol L. Eisenman, Esq., dated February 7, 2019, the notice of motion with proof of service thereof, and the affirmation of John Menard, Esq., dated February 20, 2019, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted and that the appeal is dismissed without costs.
