Jeter v. Stalder

Court of Appeal of Louisiana, First Circuit
Dec 23, 2008
No. 2008 CA 0943 (La. Ct. App. Dec. 23, 2008)

Opinion

No. 2008 CA 0943.

December 23, 2008. NOT DESIGNATED FOR PUBLICATION

ON APPEAL FROM THE NINETEENTH JUDICIAL DISTRICT COURT (NO. C557478, DIV. 25) PARISH OF EAST BATON ROUGE STATE OF LOUISIANA HONORABLE CURTIS A. CALLOWAY, JUDGE.

Ray Jeter, Homer, Louisiana, Petitioner-Appellant Pro Se.

BEFORE: KUHN, GUIDRY, AND GAIDRY, JJ.

Petitioner-appellant, Ray Jeter, an incarcerated prisoner, seeks review of the district court judgment, which affirms the decision of the Department of Public Safety and Corrections (the Department) and dismisses his petition for judicial review for failing to state a cause of action against the Department. The district court judgment also dismisses appellant's claims against the Louisiana Parole Board regarding the validity of his parole revocation as having been untimely asserted and for failing to state a cause of action.

For the reasons fully set forth in the commissioner's screening report, we affirm the district court's dismissal by this summary disposition in accordance with La. U.R.C.A. Rule 2-16.2.A.(2), (4), (5), and (6). Appeal costs are assessed against petitioner-appellant, Ray Jeter.

AFFIRMED.
