An article 78 proceeding challenging a determination made after a Fair Hearing having been transferred to this Court, pursuant to CPLR 7804(g), by order of the Supreme Court, New York County, entered on or about April 19, 2021, and petitioner having moved, pursuant to CPLR 3025(b), for leave to amend the petition, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is granted to the extent that petitioner may file a supplemental appendix containing the amended petition and, if so advised, a supplemental brief, for the June 2022 Term of this Court, to which term the perfected proceeding is adjourned, without prejudice to respondents including in their answer to the amended petition and/or in their respondents' brief(s) their objections to the amendments. Respondents may file an appendix containing their amended answer to the amended petition with their respondents' brief(s) for said June 2022 Term. 1
