Sandra and Thomas Jeter v. FV-1 Inc. in Trust for Morgan Stanley Mortgage Capital Holdings LLC., By Saxon Mortgage Services, Inc., as its attorney

ORDER Trial court case number: 65341 Trial court: 149th District Court of Brazoria County

This appeal was reinstated from a bankruptcy stay on August 16, 2016. Also on August 16, 2016, the Court issued a letter notifying appellants that the reporter's record either had not been requested or payment arrangements had not been made for its filing. We advised appellant to file the reporter's record or proof of payment for the reporter's record by 5:00 p.m., September 15, 2016, or the Court might consider and decide those issues or points that do not require a reporter's record. See TEX. R. APP. P. 37.3(c) (stating that, if clerk's record has been filed, appellate court may consider and decide those issues or points that do not require a reporter's record). Appellant did not respond.

Accordingly, the Court will consider and decide those issues or points that do not require a reporter's record for a decision. See id. Appellant's brief must be filed no later than 30 days after the date of this order. Appellee's brief will be due within 30 days after appellants' brief has been filed.

It is so ORDERED. Judge's signature: /s/ Michael Massengale
