Jester v. State

District Court of Appeal of Florida, Second District
Oct 18, 2000
779 So. 2d 457 (Fla. Dist. Ct. App. 2000)

Opinion

No. 2D99-785

Opinion filed October 18, 2000.

Appeal from the Circuit Court for Sarasota County; Nancy K. Donnellan, Judge.

James Marion Moorman, Public Defender, and Carol J.Y. Wilson, Assistant Public Defender, Bartow, for Appellant.

Robert A. Butterworth, Attorney General, Tallahassee, and Susan D. Dunlevy, Assistant Attorney General, Tampa, for Appellee.

Brian Keith Jester appeals his convictions for battery and contempt. We affirm Jester's judgment and sentence for battery without comment. Although the trial transcript shows there were serious discussions about contempt, the trial court never entered an order adjudicating Jester guilty of contempt. Thus, there is no rendered judgment or sentence for contempt on review in this case. See Fla.R.App.P. 9.020(h).

Affirmed.

THREADGILL, A.C.J., and ALTENBERND and BLUE, JJ., Concur.
