On February 7, 2024, respondent filed a Motion to Dismiss for Lack of Prosecution. On February 28, 2024, Mr. Barnes filed a Motion to Withdraw as Counsel. On March 1, 2024, Mr. Barnes filed a second Motion to Withdraw as Counsel.
This case was called from the calendar during the Court's March 4, 2024, Salt Lake City, Utah trial session. Petitioner's counsel appeared and was heard. Counsel for respondent appeared and was heard. Upon due consideration, it is
ORDERED that the Motion to Withdraw as Counsel, filed February 28, 2024, is hereby deemed stricken from the Court's record in this case. It is further
ORDERED that the Motion to Withdraw as Counsel, filed March 1, 2024, is granted and S. Mark Barnes is withdrawn as counsel for petitioner in this case. It is further
ORDERED that in addition to regular service on the parties, the Clerk of the Court serve a copy of this Order on petitioner at the additional addresses shown for him in the Motion to Withdraw as Counsel, filed March 1, 2024. It is further
ORDERED that respondent's Motion to Dismiss for Lack of Prosecution, filed February 7, 2024, is taken under advisement. It is further
ORDERED that petitioner shall, on or before April 10, 2024, show cause in writing why respondent's motion should not be granted.
Petitioner is advised that the failure to respond to this Order to Show Cause could result in the dismissal of the case and entry of decision as requested in respondent's motion.
