RACHEL JENSEN v. LANSING MOTORCYCLE CLUB INC

LC No. 23-010514-NI

Mark T. Boonstra, Presiding Judge, Jane E. Markey, Stephen L. Borrello, Judges

ORDER

The motion for immediate consideration is GRANTED.

Pursuant to MCR 7.205(E)(2), the trial court's December 4, 2023 and December 7, 2023 orders are REVERSED to the extent those orders denied the motion to change venue, and the matter is REMANDED for further proceedings consistent with this order. Plaintiff filed this suit in Wayne Circuit Court despite the fact that no party has any connection to Wayne County, and where the events giving rise to the suit took place in Missaukee County. Venue thus does not lie in Wayne County. See MCL 600.1629; MCL 600.1621; MCL 600.1627. Because defendant timely sought a change in venue, ordering a change of venue is mandatory, not discretionary. MCL 600.1651; MCR 2.223(A)(1). We thus remand the matter to the trial court, which shall order a change of venue to a proper county pursuant to MCR 2.223.

The motion for peremptory reversal is DENIED AS MOOT in light of the disposition of the application.
