Petitioner-respondent having moved to dismiss the appeal taken from an order of the Family Court, New York County, entered on or about June 27, 2018, for failure to timely perfect, and to relief her as assigned counsel,Now, upon reading and filing the motion, and due deliberation having been had thereon, it is, Ordered that the branch of the motion seeking to dismiss the appeal is denied as unnecessary, said appeal having been deemed dismissed pursuant to 22 NYCRR 1250.10(a). The motion is otherwise denied, with leave to renew upon the expiration of appellant's time to move to vacate the dismissal (see 22 NYCRR 1250.10[c]).
