ORDER

PER CURIAM.

Appellant's brief on appeal was originally due January 9, 2023. On April 14, 2023, and again on August 31, 2023, we abated this appeal and remanded to the trial court for it to determine whether appellant desired to prosecute this appeal, and if so, whether counsel had abandoned this appeal. See Tex.R.App.P. 38.8(b). On September 13, 2023, current counsel was appointed by the trial court to represent the appellant.

On counsel's motions, the time for filing was extended to January 16, 2024. Appellant's counsel has now filed a fourth motion, requesting that the Court extend the time for filing appellant's brief. We grant the motion for extension of time and order appellant to file a brief no later than February 15, 2024. No further extension of time will be granted and failure to comply with this order will result in the referral of this case to the trial court for a hearing under Rule 38.8(b) of the Texas Rules of Appellate Procedure.

It is ordered.
