Opinion
Case No. C-94-1692-VRW.
October 5, 2001
ORDER TO SHOW CAUSE
This matter was scheduled for a case management conference on October 4, 2001. Plaintiff failed to attend the conference as required and no excuse was provided for this absence.
Failure to attend a case management conference impedes the progress of litigation, can amount to a failure to prosecute (FRCP 41) or default (FRCP 55). Furthermore, FRCP 16(f) authorizes the court to impose appropriate sanctions for a party's failure to appear for a case management conference, lack of substantial preparation therefor or good faith participation therein.
Plaintiff is therefore Ordered to serve upon counsel for defendants and file with the court a written response to this order on or before October 25, 2001 or this case will be dismissed.
