On Appeal from the 134th Judicial District Court Dallas County, Texas Trial Court Cause No. DC-23-08796
Before Justices Partida-Kipness, Goldstein, and Miskel
MEMORANDUM OPINION
EMILY A. MISKEL JUSTICE
Jrmar "JJ" Jefferson, pro se, appeals the trial court's order granting Kardal Coleman's Rule 91a motion, dismissing with prejudice Jefferson's lawsuit contesting his loss to Coleman in the 2023 special election for Dallas County Democratic party chair. Jefferson appears to raise three issues on appeal arguing that: (1) the trial court did not have jurisdiction to rule on Coleman's Rule 91a motion; (2) the trial court abused its discretion when it granted Coleman's Rule 91a motion; and (3) the trial court improperly denied Jefferson a jury trial on his claims. Although this case involves an election contest, Jefferson did not request that this appeal be expedited.
During the pendency of this appeal, Coleman's term of office for which he was elected on May 22, 2023, expired and Coleman was re-elected without opposition in the March 5, 2024 primary election. As a result, Coleman filed a motion to dismiss the appeal as moot. An election contest is moot once the term in question has expired and no exception to the mootness doctrine applies. Pressley v. Casar, 567 S.W.3d 327, 331 (Tex. 2019) (per curiam).
We grant Coleman's motion to dismiss.
We dismiss this appeal as moot.
JUDGMENT
In accordance with this Court's opinion of this date, the appeal is DISMISSED as moot.
It is ORDERED that appellee KARDAL COLEMAN recover his costs of this appeal from appellant JRMAR "JJ" JEFFERSON.
