Petitioner having moved for permission to commence an original CPLR article 78 proceeding as a poor person,

Now, upon reading and filing the affidavits of Vladimir Jeanty sworn to June 16, 2011, August 9, 2010, and August 30, 2010, the proposed order to show cause, the verified petition, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is denied on the ground that the facts set forth by petitioner fail to demonstrate merit to the proceeding, and this proceeding shall be dismissed, without further order, if the three hundred fifteen dollar filing fee is not paid within 120 days of the date of this order.
