JUDGMENT


The Court today heard the appellant's motion for rehearing, and the same has been duly considered and granted. It is ordered that this Court's former judgment of November 17, 2007 be, and the same hereby is, VACATED, SET ASIDE, AND ANNULLED. The Court's opinion of November 17, 2007 is withdrawn.

The cause heard today by the Court is an appeal from the judgment signed by the court below on July 21, 2006. After submitting the cause and inspecting the record of the court below, it is the opinion of this Court that there was no reversible error in the judgment. It is therefore CONSIDERED, ADJUDGED, and ORDERED that the judgment of the court below be in all things affirmed.

It is further ORDERED that this decision be certified below for observance.
