Petitioner having moved for reargument of the order of this Court entered December 10, 2014, denying a motion for costs in this CPLR article 78 proceeding transferred to this Court by order of Supreme Court entered in the Office of the Clerk of the County of Cayuga on May 13, 2014,

Now, upon reading and filing the statement of Nathaniel Jay received December 29, 2014, the notice of motion with proof of service thereof, and the affirmation of Peter H. Schiff, Esq., dated January 9, 2015, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is denied.
