Upon consideration of the document filed May 28, 2013, by Claimant-Appellant Kimo I. Jardin, pro se, through Gary Jardin as durable power of attorney, which the court will construe as a motion to dismiss the appeal, pursuant to Hawai'i Rules of Appellate Procedure Rule 42(a), where the appeal has not been docketed, the papers in support, and the record,

IT IS HEREBY ORDERED that the motion to dismiss the appeal is granted and the appeal is dismissed. The parties shall bear their own appellate costs and fees. All other pending motions are denied as moot.
