Pursuant to the Alabama Supreme Court's opinion in Ex parte J.A.P., 853 So.2d 280 (Ala. 2002), the judgment of the juvenile court is reversed and a judgment rendered in J.A.P.'s favor.

REVERSED AND JUDGMENT RENDERED.
