The petition for writ of mandamus is granted and the Circuit Court for Union County is directed to take action on the pending motion for postconviction relief in its case number 97-073-CFA, either by rendering an order on the merits, or by scheduling a hearing. Kramp v. Fagan, 568 So.2d 479 (Fla. 1st DCA 1990). In either event, action shall be taken within 30 days of this opinion becoming final.

PETITION GRANTED.
