Curtis Elmo James appeals from a judgment of conviction, pursuant to a guilty plea, of one count of attempted murder in the first degree with the use of a deadly weapon, victim over the age of 60 years. James also appeals from a judgment of conviction, also pursuant to a guilty plea, of two counts of battery by a prisoner and one count of assault on a peace officer (by prisoner). These appeals have been consolidated. Third Judi- cial District Court, Lyon County; John Schlegelmilch, Judge.
AFFIRMED. REMAND.
