This case is currently calendared for trial at the Court's January 8, 2024, New York, New York, trial session. On December 15, 2023, respondent filed a Motion to Dismiss for Failure to Properly Prosecute.

Upon due consideration and for cause, it is

ORDERED that petitioner shall, on or before January 2, 2024, file with the Court a written response to respondent's Motion. It is further

ORDERED that respondent's Motion is set for hearing at the trial session of the Court commencing January 8, 2024, at 10:00 a.m. in the Alexander Hamilton U.S. Custom House, One Bowling Green, Courtroom 610, 6th Floor, New York City, New York 10004.

Petitioner is advised that failure to comply with this Order or to appear at the hearing may result in the granting of the Motion or other action as the Court deems appropriate.
