JAMES v. BUSS

Supreme Court of Florida
Aug 3, 2011
69 So. 3d 278 (Fla. 2011)

Opinion

No. SC11-745.

August 3, 2011.

Lower Tribunal No(s). 93-13851-CF10A.

The petition for writ of habeas corpus is hereby denied because petitioner raises the same issues as in James v. Buss, etc., No. SC10-2045 (Fla. Jan. 31, 2011), in which the petition was denied. Cf. Topps v. State, 865 So. 2d 1253 (Fla. 2004).

The Court hereby expressly retains jurisdiction to pursue any possible sanctions against petitioner. See generally Fla.R.App.P. 9.410(a) (Sanctions; Court's Motion).

Since 2007, Willie James has initiated five other cases in this Court involving the sentence imposed by the Circuit Court of the Seventeenth Judicial Circuit in and for Broward County, Florida (Case No. 93-13851-CF10A). See James v. Buss, etc., No. SC10-2045 (Fla. Jan. 31, 2011) (habeas corpus petition denied as procedurally barred); James v. McNeil, etc., No. SC10-360 (Fla. Apr. 23, 2010) (habeas corpus petition denied as a repetitive petition); James v. State, No. SC09-1017 (Fla. Sep. 3, 2009) (mandamus petition denied as procedurally barred); James v. State, No. SC08-1769 (Fla. Jan. 8, 2009) (all writs petition dismissed for lack of jurisdiction); James v. McDonough, etc., No. SC07-09 (Fla. Dec. 11, 2007) (habeas corpus petition dismissed for lack of jurisdiction pursuant to Grate v. State, 750 So. 2d 625 (Fla. 1999)).

This Court has chosen to sanction pro se petitioners who have abused the judicial process, and misused this Court's limited judicial resources by filing frivolous, or otherwise nonmeritorious filings related to their criminal cases.

It appearing that petitioner has abused the judicial process by filing multiple pro se filings in this Court that are either meritless, or not appropriate for this Court's review, the Court now takes action. Accordingly, Willie James is hereby directed to show cause on or before August 15, 2011, why he should not be barred from filing any pleadings, motions, or other requests for relief related to his conviction, or sentence in State v. James, No. 93-13851-CF10A, unless such filings are signed by a member of The Florida Bar in good standing.

PARIENTE, LEWIS, QUINCE, LABARGA, and PERRY, JJ., concur.
