Order denying motion to dismiss complaint for insufficiency affirmed, with ten dollars costs and disbursements, with leave to defendant to answer within twenty days from service of a copy of the order herein upon payment of such costs. No opinion. Rich, Young, Kapper and Carswell, JJ., concur; Lazansky, P.J., dissents, being of opinion that this is not a case for a declaratory judgment.
