James Township v. Daniel Rice

LC No. 18-038253-AV

Kathleen Jansen Presiding Judge Amy Ronayne Krause Michael F. Gadola Judges

ORDER

This Court's May 27, 2021 opinion and order affirmed Saginaw Circuit Court's opinion and order affirming the 70th District Court's denial of defendant-appellant's request for attorney fees and costs. This Court's opinion and order also remanded this matter, while retaining jurisdiction, to the district court to explain on the record its reasoning for denying defendant's request for costs and fees. On June 22, 2022, in James Township v Rice, __Mich __; ___N.W.2d __(2022) (Docket No. 163053), the Michigan Supreme Court reversed this Court's May 27, 2021 judgment and remanded this case to the district court to determine the amount of actual costs and fees defendant reasonably incurred and defendant's reasonable and actual attorney fees. In light of the Michigan Supreme Court's decision, this appeal is CONCLUDED.
