Appellant, John Jamar, has filed a notice of appeal from the trial court's final judgment. On October 12, 2023, the Court abated this appeal while the parties participated in mediation.
On January 9, 2024, appellant filed a status report, stating that the "case did not settle at mediation." Appellant requested that the Court reinstate the appeal on its active docket. We construe appellant's status report as a motion to reinstate. Appellees, Jim Nise and Julie Nise, have not expressed opposition to appellant's motion.
We grant appellant's motion and REINSTATE the appeal on the Court's active docket.
The clerk's record is ORDERED to be filed no later than 30 days from the date of this order. If the clerk is unable to file the record by that date, the clerk should request an extension for the Court to consider. If appellant has not made arrangements for paying for the clerk's record, please advise the Court in writing.
The reporter's record is ORDERED to be filed no later than 30 days from the date of this order. If the court reporter is unable to file the record by that date, the court reporter should request an extension for the Court to consider. The court reporter's motion for extension of time filed on October 27, 2023, while the case was abated, is dismissed as moot.
On October 9, 2023 and October 27, 2023, the court reporter informed the Court that appellant had requested that the reporter's record be prepared and that appellant had made arrangements to pay for the reporter's record.
