On October 12, 2023, this case was abated so that the parties could participate in mediation. The abatement order required the parties to advise the Court in writing by December 1, 2023 regarding the status of mediation. Appellant, John Jamar, filed a status report on December 14, 2023, stating that mediation has been scheduled for December 28, 2023 and requesting that the abatement continue until February 16, 202[4]. Although appellant failed to include a certificate of conference, more than ten days have passed, and appellees, Jim Nise and Julie Nise have not expressed opposition to appellant's request. See Tex. R. App. P. 10.3(a).

Appellant's request for a continued abatement is GRANTED through February 16, 2024. The parties are ORDERED to submit a status report by February 16, 2024 informing the Court of the results of their mediation efforts. If the parties do not file a status report by that date, the Court will assume the case was not resolved at the scheduled mediation, and no alternative mediation is scheduled, and will, therefore, lift the abatement and reinstate the case to its active docket.

It is so ORDERED.
