Upon due consideration of respodent's Motion to Dismiss for Failure to Properly Prosecute, filed May 15, 2023, it is

ORDERED that petitioner shall, on or before June 5, 2023, file with the Court a response to respondent's motion. Petitioner is advised that should he fail to appear at the call of the calendar on June 5, 2023 or otherwise respond to respondent's motion to dismiss, the Court may be inclined to grant respondent's motion and enter a decision against petitioner in accordance with that motion.
