No. 96-P-1904.

July 19, 1999.


The judgment dismissing the plaintiff's complaint for lack of subject matter jurisdiction is vacated and a new judgment shall enter in the Superior Court declaring that the board has jurisdiction to determine whether the plaintiff is in violation of the building code provisions for which he was cited by the building inspector and remanding the action to the board for that determination.
