BRINTON KRISTOPHER JAECKS & AMANDA JEANNE WHITE, Petitioners v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Kathleen Kerrigan, Chief Judge

On March 21, 2023, the parties filed a Settlement Stipulation and a Proposed Stipulated Decision for the Court's consideration. However, upon review of the Settlement Stipulation, the Court notes that, rather than attaching a Form 3623, Statement of Account, as indicated in the Settlement Stipulation, the parties have attached a Form 5278, Statement - Income Tax Changes, which does not appear to provide the requisite factual information for the Court to make any finding as to an overpayment in this case.

In consideration of the foregoing, it is

ORDERED that the parties' Settlement Stipulation is hereby deemed stricken from the Court's record in this case. It is further

ORDERED that, on or before May 8, 2023, the parties shall file a revised settlement stipulation.
