On October 26, 2023, respondent filed a Response to Petitioner's Motion to Shorten Time of Formal Discovery and Take Depositions Pursuant to Rule 74(c)(3) (Doc. 65). Later on October 26, 2023, respondent filed a second Response to Petitioner's Motion to Shorten Time of Formal Discovery and Take Depositions Pursuant to Rule 74(c)(3) (Doc. 66). The second Response (Doc. 66) is a duplicate of the first, except that respondent attached a Declaration of Laura J. Mullin. The Court will strike the first Response filed on October 26, 2023 (Doc. 65).
Upon due consideration, it is hereby
ORDERED that respondent's Response to Petitioner's Motion to Shorten Time of Formal Discovery and Take Deposition Pursuant to Rule 74(c)(3) (Doc. 65) filed October 26, 2023, is hereby stricken from the record in this case.
