The order denying the motion to amend the findings is affirmed. The order denying the motion to alter or amend the judgment is vacated, and a new order is to enter specifying that the June 19, 1995, judgment shall be amended to delete the phrase "on the merits" therefrom. As so amended, the judgment is affirmed.
