Jackson v. State

District Court of Appeal of Florida, Fourth District
Nov 14, 1984
458 So. 2d 865 (Fla. Dist. Ct. App. 1984)

Opinion

No. 83-1598.

November 14, 1984.

Appeal from the Circuit Court for Broward County, Frank A. Orlando, J.

Richard L. Jorandby, Public Defender, and Lawrence Duffy, Asst. Public Defender, West Palm Beach, for appellant.

Jim Smith, Atty. Gen., Tallahassee, and Russell S. Bohn, Asst. Atty. Gen., West Palm Beach, for appellee.

We affirm the convictions of first degree murder, robbery with a firearm and burglary with assault. Since we find the evidence sufficient to support a finding by the jury that appellant had acted with premeditation, we do not find State v. Pinder, 375 So.2d 836 (Fla. 1979) applicable. Accordingly, the convictions are affirmed.

AFFIRMED.

DOWNEY, DELL and BARKETT, JJ., concur.
