974 So. 2d 487 (Fla. Dist. Ct. App. 2008)

Opinion

No. 1D07-5913.

January 28, 2008.

Petition Seeking Belated Appeal — Original Jurisdiction.

Demetrius Jackson, pro se, Petitioner.

Bill McCollum, Attorney General, Tallahassee, for Respondent.

The petition seeking belated appeal is time-barred under the terms of Florida Rule of Appellate Procedure 9.141(c)(4)(A) and is therefore denied. This disposition, however, is without prejudice to the right of petitioner to challenge his sentence by filing an appropriate motion in the circuit court.

PETITION DENIED.

WOLF, KAHN, and LEWIS, JJ., concur.
