For the reasons stated in the Report and Recommendation of the Magistrate Judge previously filed herein [ECF No. 8], and after a de novo review of the record, noting the absence of objection, having determined that the Magistrate Judge's findings are correct under the applicable law; IT IS HEREBY ORDERED that the Plaintiffs Petition for Writ of Habeas Corpus under 28 U.S.C. § 2241 [ECF No. 3] is DENIED and DISMISSED WITH PREJUDICE.
