MEMORANDUM OPINION AND ORDER OF DISMISSAL
Notice of Removal was filed in the instant case on January 5, 2004.
Review of plaintiff JACKSON's litigation history reveals that he has been barred by the Fifth Circuit from filing any further pleadings, either in the appellate court or any district court of the Fifth Circuit, without first obtaining leave of court to do so or satisfying the $150.00 in sanctions assessed by the Fifth Circuit.
Further, on August 10, 2000, plaintiff was sanctioned by this Court in cause no. 2:99-CV-03 1 2, a case which had been removed to this Court from the state court. Plaintiff was instructed that, based upon his egregious conduct in a multitude of cases, plaintiff was barred from conducting any further litigation in this Court unless he first obtained permission from the Magistrate Judge or an Article III Judge. Plaintiff was also placed on notice that any claims brought in state court which were then properly-removed to the jurisdiction of this federal court, even if such removal was over plaintiffs objections, would be dismissed without analysis based upon the bar and plaintiffs long history of persistent abuse of the judicial system.
In compliance with the sanctions set forth above, the instant cause is hereby DISMISSED WITHOUT PREJUDICE.
LET JUDGMENT BE ENTERED ACCORDINGLY.
The Clerk will mail a copy of this Order to plaintiff and to each attorney of record by first class mail.
