Jackson v. Cobert

Supreme Court, Appellate Term, Second Department
Nov 22, 1995
166 Misc. 2d 770 (N.Y. App. Term 1995)

Opinion

November 22, 1995

Appeal from the Civil Court of the City of New York, Kings County, Victor I. Barron, J.

Feder, Kaszovitz, Isaacson, Weber, Skala Bass, New York City (Alvin M. Feder of counsel), for appellants.

Marshall G. Kaplan, Brooklyn, for respondents.

MEMORANDUM.

Judgment unanimously affirmed without costs.

The evidence adduced upon the trial was sufficient to support the lower court's finding that plaintiffs had not breached the terms of the contract of sale and were therefore entitled to the return of their down payment. We find defendants' other contentions raised on appeal to be equally without merit.

ARONIN, J.P., CHETTA and PATTERSON, JJ., concur.
