PRESENT:

Respondent having moved for an extension of time to file and serve a brief on the appeal taken herein from an order of the Supreme Court entered in the Office of the Clerk of the County of Erie on April 27, 2016,

Now, upon reading and filing the affidavit of James C. Cosgrove, Esq., sworn to June 15, 2017, the notice of motion with proof of service thereof, and the affirmation of Christopher R. Poole, Esq., dated June 22, 2017, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the first ordering paragraph of the order of this Court entered April 10, 2017, is hereby amended by deleting the date June 9, 2017, and inserting in its place the date July 10, 2017, and

It is further ORDERED that the second ordering paragraph of the order of this Court entered April 10, 2017, is hereby amended by deleting the date June 26, 2017, and inserting in its place the date July 25, 2017.
